Chapter 28 — Multiple Pathways of Institutional Succession After the End of the Party-state’s Monopoly Organizational Dissolution, the Transfer of Power, Civil Noncooperation, Local Self-Government, the Return of the Republic, and Democratic Constitution-Making (The Preparatory Phase)

Focus:CORE ARGUMENT OF THIS CHAPTER. This chapter renders the “elimination of the CCP” concretely as the elimination of the Party’s monopoly over state and society, rather than the annihilation of any category of persons. It takes as its normatively preferred pathways peaceful negotiation, a turn from within the system, civil nonviolent noncooperation, local self-government, the return of the Republic of China’s Republican legitimacy, an interim charter, and democratic constitution-making — among which the “restoration of the Republic” is treated as a focal point of discussion: it regards the Republic of China’s century of reform as a successful exemplar of American-style democracy on Chinese soil, and it advocates augmenting federal self-government and expanding civil rights. At the same time, it studies how, once a violent upheaval, a popular uprising, a split within the military and police, or a loss of local control has already occurred, to swiftly secure a ceasefire and halt violence, protect civilians, preserve public services, limit interim power, and transition to democratic authorization.

As for the paths of armed seizure of power, assassination, terrorist attack, popular reprisal, and civil war, this chapter does not treat them as recommended options, yet it must assess their conditions of occurrence, legal responsibility, catastrophic consequences, and the means of moving from established violence to a ceasefire, a provisional legal basis, public oversight, and democratic constitution-making; it does not provide knowledge for carrying out violence.
